Faisal Moghul Introduction:

Faisal Moghul represents businesses and individuals in complex business and commercial disputes, including but not limited to, the following:

  •    Real estate litigation: representing landlords/tenants, buyers/sellers, contractors (Classes A, B,C and General/Sub), brokers/agents, title companies, community associations (Coops/Condos/HOAs) in matters related to leasing, toxic mold, purchase/sale, mechanics liens, construction contract disputes (change orders, extra work, delay, interference, defects etc.), design covenant violations and injunctions, property encroachment (easements, fence line, nuisance etc.) disputes, adverse possession, and title related matters. 
  •    Business Litigation: representing Corporations, LLCs, LPs, trusts and other entities in complex partnership and shareholder derivative actions involving breach of the operating agreement/bylaws, contract, non-compete, confidentiality and nondisclosure issues, breach of director/officer fiduciary duty, theft of trade secrets and injunctions, fraud and tortious interference issues.
  •    Business Law: representing clients across a cross-section of industries (real estate, retail, food and beverage, technology etc.) in forming and structuring businesses tailored to maximize legal and asset protection strategies, purchase and sale of businesses (stock vs. asset), business succession and trademark related considerations.

Mr. Moghul has authored several professional papers that have been published by organizations such as the American Law Institute and the Foundation for Economic Education. His published works include "Business Entity Structuring for Real Estate Investors," "The Death of Privacy: the Fourth Amendment in the Context of Mass Surveillance" and "Of Creditors, Guarantors and Sureties: Whose Debt Is It Anyway?" He is the co-author of "The Long Road to Yes: Problems with the Permitting Process and the Need for Specific Plans in Pennsylvania." Mr. Moghul also appears as a speaker at various professional functions. In 2016, he was a speaker at the Premier Realty Lecture Series, presenting "Top 10 Problems in Real Estate Transactions," "Use of LLCs in Real Estate Transactions" and "Introduction to Asset Protection."
